Terms and Conditions

Terms and Conditions for Swimming Lessons at Emerald Anchor Swim and Train:

 

1. Payment: Payment must be made in full prior to the start of the swimming lessons. Failure to pay in full may result in the cancellation of your reservation.

 

2. Refund Policy: Refunds will not be issued for missed lessons. In the event of a medical emergency or other unforeseen circumstance, please contact Emerald Anchor Swim and Train to discuss rescheduling or refunding missed Pay Per Day (PPD) lessons.

 

3. Cancellation Policy: Cancellations must be made at least 24 hours prior to the scheduled lesson unless due to weather. Failure to cancel in advance may result in the loss of the lesson. 

 

4. Safety: All participants must follow the safety rules and guidelines set forth by the certified water safety swimming instructor. Failure to follow the rules may result in termination of the lesson and/or membership.

 

5. Health: All participants must be in good health and free from any medical conditions (ie. COVID) that may cause harm or injury during the swimming lessons. Emerald Anchor Swim and Train reserves the right to refuse service to anyone who poses a risk to themselves or others.

 

6. Safety: Emerald Anchor Swim and Train are not responsible for any injuries or accidents that may occur during the swimming lessons unless caused by negligence by the instructor. All participants assume full responsibility for their actions and safety.

 

7. Age: Participants must be at least 3 years old to participate in the swimming lessons or with a parent/guardian for Mommy and Me Classes.

 

8 Conduct: All participants must conduct themselves in a respectful and appropriate manner during the swimming lessons Emerald Anchor Swim and Train reserves the right to cancel service to anyone who behaves irately.

 

9. Schedule: Emerald Anchor Swim and Train reserves the right to modify the schedule of swimming lessons at any time prior to notice.

 

10. Certification: All water safety instructors are certified and have undergone extensive training to provide high-quality swimming lessons.

 

By enrolling in swimming lessons at A, you agree to abide by these Terms and Conditions.

Contract

CONTRACT FOR SERVICES RENDERED BY EMERALD ANCHOR SWIM & TRAIN

 

This contract is made and entered into on [JUNE 7, 2023] by and between Emerald Anchor Swim & Train ("Provider") and [Participant] ("Consumer").

 

1. Services

Provider shall provide swimming and training services to Consumer as described in the attached schedule of services.

 

2. Payment

Consumer agrees to pay Provider the amount indicated in the attached schedule of services, which includes all charges related to the Services rendered by Provider. Payment shall be made in full prior to the commencement of the Services. Provider reserves the right to refuse service if payment is not received in full.

 

3. Liability

Consumer acknowledges that swimming and training involve physical activity that may result in injury or harm. Consumer agrees to assume all risks and to release and hold harmless Provider from any and all claims, damages, or injuries arising from or related to the Services provided by Provider. Consumer agrees to maintain health insurance coverage for the duration of the Services.

 

4. Damage

Consumer shall be responsible for any damage caused to Provider's equipment or facilities during the provision of Services. Consumer agrees to pay for any repairs or replacements necessary to restore Provider's equipment or facilities to their original condition.

 

5. No Refund Policy

Consumer acknowledges that Provider's services are non-refundable. In the event that Consumer cancels or terminates the Services prior to completion, Consumer shall not be entitled to any refund.

 

6. Makeup Policy

Makeup lessons are only given for an accepted canceled lesson which includes facility closures, instructor cancellations, weather closures, closures due to throw-up or fecal matter, and consumers calling the facility saying that they are not able to come to the lesson for that day. A lesson is forfeited when consumers “no call no show”. The facility reserves the right to cancel lessons for any reasonable reason. Makeup lessons must be scheduled within two weeks of the missed lesson.

 

7. Governing Law

This Contract shall be governed by and construed in accordance with the laws of the state of Georgia. Any dispute arising under this Contract shall be resolved in the courts of Fulton, Georgia.

 

8. Entire Agreement

This Contract constitutes the entire agreement between Provider and Consumer and supersedes all prior negotiations, understandings, and agreements between the parties. This Contract may not be modified except in writing signed by both parties.
